These Terms and Conditions ("Terms") govern your use of the Boom Entertainment OTT App ("the App"), managed and operated by Boom Entertainment, Inc. ("Boom Entertainment," "we," "us," or "our"). By accessing or using the App, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the App.

1. Service Description

The Boom Entertainment OTT App offers subscription-based streaming of entertainment content, including movies, web series, documentaries, and general audience programming. Specific content availability may vary by your subscription plan.

2. Account Registration and User Obligations

You must create an account to access certain features of the App. You agree to provide accurate, current, and complete information and to update it as necessary.

You are solely responsible for maintaining the confidentiality and security of your account credentials. You must promptly notify us of any unauthorized use or breach of security.

You must be at least 18 years old to use the App. By registering, you confirm that you meet this age requirement.

• Share your account credentials
• Use the App to infringe any intellectual property rights
• Circumvent any restrictions on access or features

3. Subscription & Billing

• Subscription pricing, billing cycles, and features are clearly displayed at the point of purchase.
• Subscriptions automatically renew (monthly or annually) unless cancelled before the renewal date.
• You can manage or cancel your subscription anytime from your Account Settings.

4. Content Guidelines and Prohibited Uses

You agree to use the App only for lawful purposes. You must not:

• Attempt unauthorized access to the App or its servers
• Reproduce, modify, redistribute, or publicly display content without written permission
• Upload or transmit viruses or harmful code
• Engage in actions that harm the App, users, or its performance

5. Intellectual Property & DMCA Compliance

All content, trademarks, logos, and features of the App are the exclusive property of Boom Entertainment or its licensors and are protected under applicable intellectual property laws.

6. Privacy Policy

Use of the App is subject to our Privacy Policy. By using the App, you agree to our data collection, usage, and storage practices as described.

7. Payment Terms

• Certain features of the App require a paid subscription.
• All payments are processed via Unified Payments Interface (UPI) only. We do not accept credit/debit cards.
• Payments are securely handled by third-party UPI providers. Boom Entertainment does not collect or store your UPI credentials.
• All subscription prices are listed in Indian Rupees (INR) unless specified otherwise.
• Subscriptions auto-renew monthly or annually depending on your selected plan.
• You may manage or cancel subscriptions via the Account Settings in the App.
• If a payment fails or remains unpaid, your access to premium content may be suspended.
• All payments are final and non-refundable, unless explicitly stated in our refund policy.

8. Disclaimers & Limitation of Liability

• The App is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted access, accuracy, or completeness of content.
• Boom Entertainment shall not be liable for indirect, incidental, or consequential damages.
• Our total liability to you will not exceed the subscription amount paid in the last 12 months.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, specifically under the jurisdiction of Maharashtra.

Any disputes shall be resolved exclusively through binding arbitration conducted by the Indian Council of Arbitration under its Commercial Arbitration Rules. The seat of arbitration will be Mumbai, India.

10. Modification to Terms

We may update these Terms at any time. Any changes will be posted on the App with a revised "Effective Date." Continued use of the App after changes means you accept the updated Terms. We will notify users of material changes where required.

11. Age Guidelines

You must be at least 18 years old to use the App. We do not knowingly allow users under 18 to register or access content. We do not offer explicit or adult content, but all users must be legally eligible to view the platform's materials.

12. Termination

We may suspend or terminate your account at our discretion, with or without notice, if we believe you have violated these Terms or acted unlawfully.
